Welcome to Eternal Presence (www.eternalpresence.co). These Terms and Conditions ("Terms") govern your use of our website and the purchase of our bespoke memorial products. By accessing our site or commissioning a work, you agree to be bound by these Terms.

1. Bespoke Services & The "Legacy Process"

Eternal Presence provides custom-crafted memorial busts and art pieces using a proprietary "Legacy Process" involving photo analysis and 3D modeling.

• Artistic Interpretation: You acknowledge that our products are artistic representations. While we strive for meticulous accuracy, the final output is an interpretation based on the photographs provided by you.

• Client Responsibilities: You are responsible for providing high-quality, clear photographs. The quality of the final product is significantly influenced by the quality of the source material provided.

2. Orders and Commissions

• Bespoke Nature: Because we accept only a limited number of commissions per month, your order is a binding commitment to the artist's time and resources.

• Acceptance: We reserve the right to refuse a commission for any reason, including but not limited to poor photo quality or technical impossibility. In such cases, a full refund of any deposit will be issued.

3. Payment Terms

• All prices are listed in AUD and are subject to change.

• Full payment or a designated deposit (as specified at checkout) is required to secure your place on the waitlist and begin the design process.

4. Cancellation and Returns Policy

Your satisfaction is our priority, but due to the highly personalized nature of our work, the following rules apply:

• Pre-Printing: You may cancel your order before the physical printing process begins. However, a "Design Fee" may be retained to cover the hours invested in photo analysis and 3D modeling.

• No Returns After Printing: Once the physical printing of your commission has commenced, there are no returns, refunds, or cancellations.

• Damaged Items: If your item arrives damaged, you must notify us at Info@eternalpresence.co within 48 hours of delivery with photographic evidence of the damage and packaging. Verified damaged items will be replaced at no additional cost.

5. Intellectual Property

• Our Content: All designs, text, graphics, and 3D modeling techniques on www.eternalpresence.co are the intellectual property of Eternal Presence.

• Your Content: By submitting photos, you represent that you own the rights to those images or have permission to use them. You grant Eternal Presence a limited license to use these images solely for the purpose of creating your commissioned piece.

6. Materials and Longevity

We use archival-grade materials intended for long-term preservation. However, like all fine art:

• Exposure to extreme temperatures, direct sunlight, or high humidity may affect the piece over time.

• Eternal Presence is not liable for natural wear and tear or damage caused by improper handling or environmental exposure after delivery.

7. Limitation of Liability

To the maximum extent permitted by law, Eternal Presence shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our website or products. Our total liability for any claim shall not exceed the amount paid by you for the specific product in question.

8. Privacy

Your use of our site is also governed by our Privacy Policy, which outlines how we handle your personal data and uploaded photographs.

9. Governing Law
